Xsonly Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from xsonly.com.

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.  We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

Communicate with you;

Screen our orders for potential risk or fraud; and

When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SHARING YOUR PERSONAL INFORMATION

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

MINORS

The Site is not intended for individuals under the age of 16.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

XSonly are committed to safeguarding the privacy of our customers – we will only use information that we have collected about you lawfully in accordance with the Data Protection Act 1998 (naturally we are registered with the Data Protection Registrar).
The only information that we collect is necessary for the processing/verifying of your order and delivery of your goods – this includes name, address, phone number, e-mail address and credit card details. We may also have to collect certain other details as necessary for any security checks made by the credit card companies.
We keep this information as up to date as possible – if you want to check any information that we hold, please contact us. If there are any errors, we will correct them as necessary.
We will not send you any unsolicited e-mails. We do send out a regular e-mail stock update to which you can easily subscribe (and un-subscribe) but you will only receive this if you subscribe via our web site.
We will not give, sell or swap your details with any third party companies.

Security Statement

We take matters of web security very seriously – when you go to our on-line ordering system, you are transferred to a secure are of our server using secure server software (SSL). This means that the information that you send is coded so that only we can de-code the information to obtain your personal details.
You will notice that the address will change from http:// to https:// indicating a secure server and that a padlock will appear at the bottom of the page.

Terms & Conditions

All sales are subject to the following trading terms – these terms and conditions do not affect the consumers’ statutory rights.
We guarantee that the equipment that we supply will be to the correct specification as advertised however we are unable to guarantee precise compatability or suitability. It is the responsibility of the customer to check this prior to ordering. We try to ensure that all information provided is as accurate as possible but we cannot be held responsible for any typographical errors in our advertising on our website.
We reserve the right to accept or reject any order for any reason whatsoever. No order will be considered binding unless and until it is accepted by the company.
All prices quoted are in £ sterling. UK and EU residents pay the VAT inclusive price (inclusive at the current rate of 20%).
Payment terms are cash, cheque (subject to guarantee/clearance), credit/debit card, bank draft/building society cheque or bank transfer. Personal or business cheques not covered by a guarantee card are subject to a 10 working day clearance period. Express clearance is available at a small charge.
30 day credit terms may be offered to approved accounts – public sector and major PLCs.
Title of the goods remains with Westcoast Limited until payment has been made in full. Parcels are shipped same day on most orders placed before 2PM. For larger items we ship via Parcelforce Express. This is a next working day (not including Saturday, Sunday or Bank Holidays) overnight service. We ship Monday to Friday, any orders placed on the weekend will be shipped Monday. We send out tracking information once we have shipped the item, normally late afternoon / early evening. The tracking e-mail also includes a VAT invoice for your purchase. We charge a flat £7.99 on laptops and PCs. Non UK Mainland standard are more expensive. Please contact us with any queries at info@xsonly.com
Delivery prices are quoted for UK mainland addresses only – certain areas of the Highlands and Northern Scotland may attract a surcharge. For delivery other than mainland UK please contact us for a quote.
We will give you an estimated date of despatch for your order. If these dates cannot be met for whatever reason we will try to keep you informed of any delays and when you can expect delivery. Whilst we make every effort to keep to stated delivery times, we cannot be held liable for any losses or costs incurred as a result of a failure to meet estimated delivery dates and times.
Any incorrect items or shortages to your delivery must be advised to the company within 7 days of delivery and damaged items within 48 hours. Provided that this notice is given, we will collect, replace, repair or refund the equipment free of charge.
All goods are offered subject to stocks and availability. If for any reason they are no longer available we will try to offer an alternative product, otherwise we reserve the right to cancel the contract and offer a refund.

Consumer Law

These terms and conditions do not affect the statutory rights of the consumer. We meet our obligations under the current consumer regulation in force including:
The Sale of Goods Act, 1979
The Supply of Goods and Services Act, 1982
The Trade Descriptions Act, 1968
The Unfair Contract Terms Act, 1997
The Consumer Protection Act, 1987
The Consumer Protection (Distance Selling) Regulations, 2000

Your Right To Cancel

Under The Consumer Contracts Regulations, you have the right to cancel a contract within 14 days – starting from the day after you take delivery of the goods (a “cooling off” period). You have the right to cancel for any reason without penalty within 14 days. If you wish to cancel a contract please e-mail clearly stating your full details, invoice number and cancellation instructions. To cancel the contract, you must give us notice within 14 working days starting from the day after you take delivery of the order.
Once you have cancelled the contract, you have a legal “duty of care” to take good care of the goods. You must return the goods to us at your expense - we would advise that you use a recorded-delivery service for small items and an insured courier service for larger items. Please mark all parcels clearly with your returns number.
If you are returning goods under the Consumer Contacts Regulations the return costs are borne by the buyer and this is will not be refunded by XSonly.
We will refund you the full amount paid for the goods, less any shipping costs, within 30 days of receipt of the notice of cancellation.

Once the 14 day returns window closes any faults will be resolved under the terms of the warranty supplied with the product.

 

Consumer Contracts Regulations do not apply to trade sales. Returns may be accepted at our discretion subject to a re-stocking fee.

Warranties

All brand new goods are covered by a one year warranty, covering parts and labour. Some manufacturers include extended or on-site warranties which are in addition to our standard warranty.
In the case of second-hand, ex-demonstration and refurbished equipment, warranty periods may vary but in all cases these are clearly stated.

All machines will be supplied with a warranty.

Due to the nature of refurbished / surplus stock the warranties can vary but we do state the type & length of warranty for each machine in our on-line listings.

We offer a 14 days returns windows Under The Consumer Contracts Regulations. Once this 14 day returns window closes any faults will be resolved under the terms of the warranty supplied with the product.

We are not responsible for any consequential loss or expenses, however caused, including incidental returns costs.

All goods remain the property of Westcoast Limited until paid for in full.

Fraud Statement

Unfortunately levels of fraudulent orders, particularly via the internet, are on the increase.
We make every effort to check all orders as thoroughly as possible given the information available so please do not be offended if we have to contact you to make additional security checks after you have placed your order.
For reasons of security, we will only deliver goods to the registered billing address for your credit card.

Customer Services

In and ideal world everything would run like clockwork but unfortunately we are only human and occasionally mistakes happen or problems arise. We aim firstly to keep these to a minimum and secondly to address and resolve any problems quickly and efficiently.
In the first instance please e-mail info@xsonly.com. We undertake to deal with any problems effectively, confidentially and within the conditions that are outlined in our Terms and Conditions. We will acknowledge your complaint within 2 working days and give you a time-scale for getting the matter resolved. We will further keep you informed of progress towards a resolution and any unforeseen delays that might have occurred.
